Selected correspondence and contemporaneous source material concerning commissioning, the K15aa updated background report, operational noise observations and later Trustee enquiries.

Capacity and chronology

Beneficiary record and continuing Trustee administration

The earlier correspondence was created by the Beneficiary before establishment of the Owen Robert Inter Vivos Trust. Following establishment of the Trust, the Trustee incorporated that material into the continuing administrative and evidentiary record. The original capacity and chronology are preserved.

4–7 October 2024

Final-turbine commissioning enquiry

The Beneficiary asked what authority required notification of turbine commissioning dates or requested the final commissioning dates for the Yendon and Elaine sections. The operator stated that its notifications and reports were completed in accordance with planning requirements and that it was not obliged to provide the requested information.

K15aa updated-background-report enquiry

The correspondence identifies the February 2021 SLR K15aa report, refers to the endorsed NCTP submission requirement and asks the operator to verify the report submitted to the Responsible Authority before operation.

15 August 2024

Operational noise complaint and contemporaneous logger material

The record preserves the complaint, follow-up correspondence, later operator response, logger display photograph and supporting video. A dedicated documentary page now places the 3:34 am logger material beside the operator's recorded 9.5 m/s wind figure and the K15aa night-time noise-limit table that SLR used as the representative limit framework for J14aa.

Complaint and response

Records the operational observations, reported family impact, the operator's stated wind data and the question whether the on-site logger data formed part of the investigation.

Logger display photograph

The visible display records LAeq 47.8 dB, LAF90.0 45.6 dB, wind speed 1.2 m/s and wind direction 317° at approximately 3:34 am.

Dedicated case study

Reconciles the contemporaneous logger display, the operator's complaint response and the K15aa night-time limit table, while preserving the distinction between displayed logger values and a formal compliance determination.

The Trustee's later enquiries preserve the continuing administrative pathway without changing the character of the earlier Beneficiary correspondence.

Commissioning certificate

Formal enquiry dated 23 February 2026 seeking documentary confirmation of the final-turbine commissioning milestone.

Planning Permit Conditions 23–27

Formal enquiry dated 25 February 2026 asking whether the conditions had been formally discharged or satisfied and requesting any instrument recording that determination.

Blade-failure incident

Trustee correspondence concerning debris recovery, dispersion, surrounding land and waterways, authority notification and community information. The record now includes the 29 May provision of the earlier footage to EPA South West and Central Highlands Water, EPA's 15 June ENQ231138 statement identifying its role in ensuring appropriate disposal and clean-up, and the 27 August Trustee follow-up providing the later 104-day footage and seeking EPA's current substantive position.

21–31 July 2026

Crystallised Administrative Position — procedural opportunity completed

On 21 July 2026, the Trustee issued the Notice — Crystallised Administrative Position to the Lal Lal Wind Farm Operator. That Notice afforded the Operator a reasonable opportunity to identify any additional documentary material, authorising document or documentary explanation relevant to the twelve matters identified in Schedule 1.

On 31 July 2026, the Trustee issued a further Notice — Completion of Procedural Opportunity. That Notice records that the procedural opportunity previously afforded had concluded and that, as at its date, no substantive response had been received identifying additional documentary material, an authorising document or a documentary explanation relevant to the matters raised.

The Trustee records that it will proceed upon the basis of the documentary record as presently reconciled. The completion Notice does not expand the earlier Notice. Should relevant documentary material later be identified, the Trustee remains willing to consider it as part of the continuing administrative and evidentiary record.

Professional acoustic record - opportunity to clarify

The professional-clarification record comprises the Trustee's 26 July 2026 Notice and two later information-only emails sent while the opportunity remained open. Read together, the correspondence shows what material was made available to Mr Gustaf Reuterswärd and SLR before the response period concluded.

The later emails did not amend or expand the Notice. They provided access to further SAC material on 29 July and, on 5 August, forwarded DTP's 4 August FOI clarification concerning the absence of located documents responsive to Part 4 of FOI CS019200.

26 July 2026

Notice issued

The Trustee issued the Notice - Opportunity to Clarify Professional Positions and Authorising Basis. It invited Mr Reuterswärd to identify clarification, additional documentary material or an authorising basis not presently apparent within the Trustee's record. The Notice expressly stated that it was not an allegation of wrongdoing or professional misconduct and did not record a concluded finding.

29 July 2026

SAC material forwarded for information

The Trustee advised that the public Special Audible Characteristics record had been expanded with additional documentary material, including public presentation material. The email stated that the material was supplied solely for information and convenience and did not amend, supplement or otherwise alter the 26 July Notice.

3 August 2026

Original response date passed

The response date stated in the Notice passed. The Notice had allowed additional time to be requested if reasonably required.

4 August 2026

DTP issues supplementary FOI clarification

DTP advised that its Energy and Infrastructure Assessment Branch did not believe the Department possessed any document, instrument or written authority permitting or authorising departure from the identified NZS 6808:2010 definitions of background sound level and notional boundary. DTP further stated that, following relevant enquiries, it was unable to locate documents responsive to Part 4 of FOI CS019200.

5 August 2026

DTP clarification forwarded to SLR for information

The Trustee forwarded DTP's 4 August clarification to Mr Reuterswärd and Mr Paul Gardiner of SLR so that any response they might choose to provide could be made having regard to the current documentary record. The email again stated that the 26 July Notice remained unchanged.

8 August 2026

No response recorded

As at 8 August 2026, the Trustee records that no response, acknowledgement or request for additional time has been received in response to the Notice or the later information-only correspondence.

No adverse inference is drawn merely from the absence of a response. The record therefore remains without clarification or additional material from Mr Reuterswärd in response to the opportunity afforded.

Separate Beneficiary process

2 August 2026 - Australian Acoustical Society complaint

Separately from the Trustee's administrative process, the Beneficiary advised the Trustee that, in his private capacity, he had lodged a formal professional-conduct complaint with the Australian Acoustical Society concerning professional acoustic work associated with the Lal Lal Wind Farm.

The Beneficiary provided that information to the Trustee for information and administrative-record purposes only, without requesting that the Trustee adopt or endorse the complaint.

Current status: The existence of the complaint is recorded as a procedural event only. No finding or determination by the Australian Acoustical Society is presently recorded. The Trustee does not presently publish the complaint itself. If the Society later makes findings or otherwise determines the matter, resulting correspondence or a determination may be added to this documentary record where appropriate.
