Four distinct August 2026 pathways

The two Moorabool Shire Council matters are deliberately separated because the documents themselves identify different subject matter.

Moorabool Shire Council — Condition 17 records enquiry / non-response

The online complaint concerned Council's failure to substantively respond to or adequately administer the Trustee's enquiry seeking to establish whether Council had received the final monitoring report or reports required under Condition 17 of Planning Permit PL-SP/05/0461.

The underlying correspondence began on 13 July 2026 and was followed up on 23 July, 29 July and 10 August. By 10 August the Trustee recorded that it had received no substantive response, no Council reference number and no identification of the officer or business area dealing with the enquiry.

24 August procedural position: the Ombudsman advised that no further action would be taken under C/26/15485. The description in that correspondence referred to Council's 2022 permit-compliance assessment, technical advice and record gaps. The Trustee therefore sought clarification as to whether the assessment related to the 14 August online complaint, which concerned the separate Condition 17 non-response pathway. The material supplied for this update does not contain a later response to that clarification request.

EPA Victoria — regulatory decision-making and continuing compliance position

The Trustee lodged a complaint concerning EPA's own administrative and regulatory decision-making in relation to Lal Lal Wind Farm. The complaint asks how EPA determined, and could continue to maintain, that the wind farm demonstrated compliance with the historical Condition 23(a) pathway when the later documentary record identified unresolved matters concerning NZS 6808:2010, the endorsed NCTP and the final-turbine commissioning trigger.

The complaint expressly seeks investigation of EPA's administrative decision-making rather than asking the Ombudsman to undertake an acoustic assessment itself.

Moorabool Shire Council — historical administration and 2022 no-breach determination

This separate complaint concerns the quality, adequacy and documentary foundation of Council's historical administration and investigation of Planning Permit PL-SP/05/0461, particularly the December 2022 determination that Lal Lal Wind Farm was not in breach of the permit.

The complaint expressly distinguishes itself from C/26/15485: C/26/15485 concerns failure to respond to more recent enquiries, whereas the 18 August complaint concerns the underlying historical administrative process and the foundation for Council's earlier determination.

Department of Transport and Planning — permit administration and 2026 amendment

The Trustee lodged a complaint concerning DTP's own conduct and the Ministerial planning framework, including DTP's stated position that submitted post-construction noise assessments demonstrated compliance with NZS 6808:2010, the documentary foundation for that position, later FOI outcomes, Ministerial responsibilities and administration of the 2026 permit amendment.

The complaint asks for independent administrative examination of the documentary and statutory foundation for DTP's position and subsequent permit administration; it does not ask the Ombudsman to determine acoustic compliance itself or the legal validity of the amended permit.

Related, but not interchangeable

The complaints necessarily overlap in documentary material because EPA, DTP and Moorabool Shire Council dealt with different parts of the same planning and regulatory pathway. The public record preserves the distinction between each authority's conduct and the separate Council non-response matter.
